INFORMATION CLAUSE FOR EMPLOYEES

In accordance with the information obligation implemented in connection with Art. 13 of Regulation
(EU) 2016/679 of the European Parliament and of the Council, hereinafter referred to as GDPR, we would like to inform you that:

1) The data administrator is Vikar Invest II ApS with its registered office in Denmark, Odense, at Wichmandsgade 8, 5000 Odense C. Telephone contact: +45 70 60 20 64 and e-mail: info@vikarinvest.dk

2) Your personal data will be processed for the purposes of:
a) conclusion and implementation of an employment relationship and performance by Vikar Invest II ApS of matters and obligations of the employer and employee arising from generally applicable and internal labor law provisions, including:
● keeping employee files
● calculation and payment of remuneration and other benefits due to the employee and implementation of remuneration classes
● fulfillment of insurance, tax and accounting obligations
● performing activities related to possible organizational liability of employees, liability of employees for damage caused to the employer, liability of employees for property entrusted to the employee, including determining and pursuing possible claims
● organizing additional benefits for employees
● assessment of the employee’s ability to work
● archiving employee documents, including employee’s personal files
● sharing data with entities authorized to do so under the law and entities which, under the law, have the right to request and receive information about the employee, in particular for the purpose of the employee exercising special rights provided for in labor law

a) implementation of current and/or future recruitment processes (Article 6(1)(a/b) of the GDPR), in the scope of: name, surname, date of birth, CPR and PESEL number, bank name and account number, contact details, education, professional qualifications and history of previous employment
b) conducting the business of an employment agency, in particular: conducting recruitment, concluding and implementing an employment agency contract, as well as taking actions before concluding the contract, and further for archival purposes

The grounds for processing this data are:
a) art. 6 section 1 letter b) GDPR – processing is necessary to perform a contract to which the data subject is a party or to take action at the request of the data subject before concluding the contract
b) art. 6 section 1 letter a) GDPR – the data subject has consented to the processing of his or her personal data for one or more specific purposes
c) art. 6 section, 1 letter c) GDPR – processing is necessary to fulfill the obligations of Vikar Invest II ApS as an employer
d) art. 6 point 1 letter f) GDPR – this means that we process personal data in order to pursue legitimate interests
e) art. 9(2)(a) b) GDPR – processing is necessary to fulfill obligations and exercise specific rights by Vikar Invest II ApS or the data subject in the field of labor law, social security and social protection
f) art. 9(2)(a) a) GDPR – the data subject has expressed express consent to the processing of these personal data for one or more specific purposes, unless EU or Member State law provides that the data subject cannot waive the prohibition referred to in paragraph 1
g) art. 9 section 2 letter h) GDPR – processing is necessary for the purposes of health prevention or occupational medicine, to assess the employee’s ability to work, medical diagnosis, provision of health care or social security

3) The recipients of your personal data may be:
a) SKAT, Udbetaling Danmark, FerieKonto, NemKonto, Kommune (the given municipality to which you are assigned), Joint Controllers, postal and courier service providers, partners, contractors and clients (only in the scope of business data, and in the remaining scope only after obtaining a separate, voluntary consent of the employee), e-mail host and server host, Google Inc., Zoho Corporation, accounting services provider.

4) Your personal data will be stored for the period necessary to achieve the purposes for which the data was collected, or until you withdraw your consent to the processing of personal data for the purpose specified in the consent.

5) Pursuant to the principles and cases provided for in the provisions of the GDPR, you have the right to request from the administrator access to personal data, rectification, deletion, limitation of processing, objection to data processing, transfer of data and the right to withdraw consent to the processing of personal data, in the event of processing based on your consent. A declaration of withdrawal of consent to the processing of personal data must be submitted in writing or electronically to the e-mail address of the Administrator.

6) You have the right to lodge a complaint with the supervisory authority.

7) Providing data is voluntary, but refusing to provide it results in the impossibility of establishing an employment relationship or preventing Vikar Invest II ApS as an employer from fulfilling certain legal requirements. In other respects, the consequence of failure to provide data may be: inability to use certain benefits and training, difficult execution of the contract.

8) The data is not subject to automated decision-making, including profiling.

9) Your personal data will not be transferred outside the European Economic Area (EEA), except when necessary, indicated below:
a) in connection with the use of Google services, due to Google storing data in data centers also located outside the EEA. These servers are located in the United States, which has not been recognized by the European Commission as a safe country for the processing of personal data. However, the data will be safe due to the use of standard personal data protection clauses, ensuring that Google implements appropriate security measures. b) in connection with your activity on social networking sites (e.g. Facebook, YouTube and others) where Vikar Invest II ApS runs social profiles and marketing activities

10) Your personal data will be made available to Joint Controllers, entities entrusted with data processing on the basis of concluded contracts, as well as other entities and institutions authorized by law.

INFORMATION ON THE CONDITIONS OF PROCESSING PERSONAL DATA OF JOB CANDIDATES

1) The data controller is Vikar Invest II ApS with its registered office in Denmark, Odense, at Wichmandsgade 8, 5000 Odense C. Telephone contact: +45 70 60 20 64 and e-mail: info@vikarinvest.dk.

2) Personal data to the extent indicated in the provisions of labor law will be processed in order to conduct the current recruitment process, pursuant to Art. 6 section 1 letter b) GDPR. Other data provided for this purpose or for participation in future recruitment processes will be processed on the
basis of the consent granted, in accordance with Art. 6 section 1 letter a) or art. 9 section 2 letter a) GDPR.

3) We would like to inform you about the right to withdraw your consent to the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of the previous processing.

4) We also inform you about your right to access your data, rectify it, delete it, limit processing, as well
as the right to lodge a complaint.

5) Providing data regarding: name, surname, contact details, date of birth, education, professional
qualifications and previous employment history is necessary in order to participate in the recruitment
process. Providing other data is voluntary.

6) Personal data will be processed for 3 months from the completion of recruitment (conclusion of the target contract) or, in the case of appropriate consent, until its withdrawal.

7) The recipients of personal data will be: the email hosting provider and the server hosting provider.
